F.S. 435.05
Requirements for covered employees and employers
The deadlines in chapter 435 that almost nobody quotes. The employer must send the screening information to FDLE within five working days of receiving it, and the person being screened has 30 days to supply anything missing. Every licensed employer also files a signed attestation of compliance each year or at licence renewal.
What 435.05 actually says

- Employer submits the information to FDLE within 5 working days of receiving it — 435.05(1)(b) for Level 1 and 435.05(1)(c) for Level 2.
- The person being screened has 30 days to supply missing information after being asked for it — 435.05(1)(d).
- Every employee attests under penalty of perjury that they qualify, and agrees to tell you immediately if they are arrested for a disqualifying offence while employed — 435.05(2).
- Every employer licensed or registered with an agency files a signed attestation of compliance annually or at licence renewal, under penalty of perjury — 435.05(3).
