F.S. 435.11
Penalties
Two criminal offences sit in this chapter. Concealing a material fact on an employment application for a position of special trust is a first-degree misdemeanour, and so is misusing screening records. Misusing juvenile records information is a third-degree felony.
What 435.11 actually says

- First-degree misdemeanour: failing by false statement, misrepresentation, impersonation or other fraudulent means to disclose a material fact on an application for paid or voluntary employment — 435.11(1)(a).
- First-degree misdemeanour: using screening records for anything other than employment screening, or releasing them to others for another purpose — 435.11(1)(b).
- Third-degree felony: using or releasing juvenile records information for an unpermitted purpose — 435.11(2).
